Terms and Conditions of Homzi Stay

1. Acceptance of Service

By using the website (homzistay.co.in) or booking any property through Homzi Stay, you acknowledge and agree to be bound by these Terms and Conditions (T&C).

2. Definitions

  • “Homzi Stay” or “We”: The entity operating the website and rental services.

  • “Tenant” or “You”: The person booking or residing in the property.

  • “Property”: Any residential unit (PG/Hostel/Flat) managed by Homzi Stay provided to the Tenant.

  • “Security Deposit”: The amount submitted by the Tenant at the time of booking against damages and outstanding dues.

3. Booking, Payments, and Rent

  • The Tenant is liable to pay the monthly rent and any applicable taxes for the agreed booking period.

  • Rent payment dates and methods shall be specified in the subscription agreement.

  • Delayed payments may attract late fees as per the Homzi Stay policy.

4. Tenant-Specific Policies

4.1. Lock-in Period Policy

  • Mandatory Lock-in: A mandatory lock-in period of 120 days applies from the date of move-in.

  • Exit within Lock-in: Exit requests raised within the lock-in period will attract applicable charges as per Homzi Stay policy.

4.2. Notice Policy

  • Ending Your Stay: To end your stay at Homzi Stay, you must raise an Exit Notice.

  • Initiation: An Exit Notice is considered initiated only when you formally communicate your intent to vacate the property via your registered email.

  • Time Frame: You are required to initiate your notice at least 60 days prior to your intended move-out date. Checkout will not be permitted without a valid notice.

  • Third Parties: Notices raised by friends or third parties will not be accepted for security reasons.

  • Dues Clearance: All outstanding payments (rent, utilities, damages) must be cleared to activate the notice. If any dues remain unpaid, the notice will remain unaccepted.

  • Security Deposit Adjustment: Last month’s rent cannot be adjusted against the Security Deposit.

  • Cancellation/Extension: Cancellation or extension of notice is subject to the Notice Extension/Cancellation Policy.

4.3. Security Deposit Refund Policy

Your security deposit is fully refundable, subject to the following:

  1. Clearance of all outstanding dues.

  2. No damage to property or assets.

  3. Completion of the 60-day notice period.

  4. Timely rent and bill payments throughout the tenancy.

  5. Bank account details must be confirmed by you to process the refund.

5. Use of Property and Conduct

The Tenant agrees to maintain the property and its common areas in good condition. The Tenant will be responsible for any loss or damage to the property, and the cost of repairs may be deducted from the Security Deposit.

6. Limitation of Liability

Homzi Stay shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the services.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by the laws of India. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts located in Varanasi, Utter Pradesh
